1. 43 Second, even if it were necessary to read in Article 7 of Regulation No 1538/91 the term ‘prepackage’ instead of ‘unit’, that is, to accept a wording according to which the tolerance margins laid down relate to prepackages, it is appropriate to apply the analysis of the referring court and that of the Advocate General set out in paragraphs 45 and 46 of his Opinion, according to which those tolerance margins should also be applied by analogy to non-prepackaged products.

43 Zweitens ist, selbst wenn in Artikel 7 der Verordnung Nr. 1538/91 der Begriff „Fertigpackung“ an Stelle des Begriffes „Einheit“ zu lesen, d. h. von einem Wortlaut auszugehen sein sollte, wonach die aufgeführten Toleranzgrenzen für Fertigpackungen gelten, der Auffassung des vorlegenden Gerichts und der vom Generalanwalt in den Nummern 45 und 46 seiner Schlussanträge vertretenen Ansicht zu folgen, dass diese Toleranzgrenzen entsprechend auch für nicht in Fertigpackungen enthaltene Erzeugnisse gelten müssen.
